PLEASE READ CAREFULLY

By creating an account, signing in, accessing, browsing, or using Culicy, you agree to these Terms of Service, our Privacy Policy, and our Community Guidelines. If you do not agree, do not use Culicy. These Terms include important information about subscriptions, Google Play billing, refunds, AI-generated content, community behaviour, account deletion, consumer rights, and dispute resolution.

1. Introduction and Acceptance

These Terms of Service ("Terms") form a legally binding agreement between you and Culicy AI Innovations, a sole proprietorship ("Culicy", "we", "us", or "our"), governing your use of the Culicy mobile application, website, and related services (the "Service").

By using Culicy, you confirm that you have read, understood, and agree to these Terms, our Privacy Policy, and our Community Guidelines. If you use Culicy on behalf of another person or organisation, you represent that you have authority to accept these Terms on their behalf.

If you do not agree to these Terms, you must not create an account or use the Service.

2. Your Culicy Account

2.1 Account information

· You must provide accurate, current, and complete information when creating or updating your account.

· You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

· You must notify us promptly if you suspect unauthorised access or security misuse.

2.2 Supported sign-in methods

· Culicy supports email/password sign-in and supported third-party identity providers such as Google Sign-In.

· Email/password accounts must verify their email address before full access to the Service is allowed.

· Anonymous access is not supported. Culicy may block, sign out, or restrict accounts or sessions that are anonymous, unverified, fraudulent, or otherwise unauthorised.

2.3 Account deletion

· You may delete your account in the app through Settings > Delete Account.

· You may also request account deletion at https://culicy.com/delete-account or by emailing support@culicy.com from your registered email address.

· When an account is deleted, we delete or anonymise personal data according to our Privacy Policy and applicable law, except where retention is required for legal, security, billing, or compliance purposes.

3. Eligibility and Age Requirements

You must be at least 13 years old to use Culicy, or the higher minimum age required in your country. If you are a minor, you may use Culicy only with the consent and supervision of a parent or legal guardian.

Where local law requires parental or guardian consent for users under a certain age, you must obtain such consent before using Culicy. You may not use Culicy if you are legally barred from receiving the Service under applicable law.

4. Subscriptions, Billing, Cancellation, and Refunds

4.1 Plans and features

Culicy may offer free and paid subscription tiers. Features, limits, prices, currencies, trial availability, and promotional offers may vary by country, platform, time, and subscription period. Current pricing and plan details are shown in the app before purchase.

4.2 Google Play billing

· All Android purchases and subscriptions are processed through Google Play Billing. Culicy does not store your payment card details.

· Subscriptions renew automatically unless cancelled before the renewal date through Google Play.

· You can manage or cancel your subscription through Google Play Store > Account > Payments and subscriptions > Subscriptions.

4.3 Refunds

· Purchases and refunds are governed by Google Play policies and applicable law. Please request refunds through Google Play.

· Culicy does not independently process refunds for purchases made through Google Play, unless required by applicable law or platform rules.

· Nothing in these Terms limits any non-waivable refund, withdrawal, cancellation, or consumer protection rights you may have under the laws of your country, state, or province.

4.4 Changes to subscriptions

· We may change plan features or prices in the future. Where required, we will notify users in advance and changes will apply according to platform rules and applicable law.

· If you do not agree to a subscription change, you may cancel before the change takes effect.

5. Acceptable Use

5.1 You may

· Use Culicy for personal, non-commercial cooking, recipes, meal planning, pantry organisation, shopping lists, and culinary inspiration.

· Share food-related posts, photos, recipes, comments, and helpful tips in the community, where community features are available.

· Use AI features for recipe ideas, cooking guidance, meal planning, and related food assistance.

5.2 You must not

· Post illegal, harmful, abusive, harassing, hateful, defamatory, obscene, violent, discriminatory, or sexually explicit content.

· Post misleading, unsafe, or dangerous food, nutrition, health, dieting, or allergy information.

· Infringe copyrights, trademarks, privacy rights, publicity rights, or other rights of any person or organisation.

· Impersonate another person, chef, brand, company, public figure, or Culicy representative.

· Use Culicy commercially, sell products or services, scrape data, spam, advertise, or promote external links without our written permission.

· Reverse engineer, decompile, attack, overload, bypass, interfere with, or compromise Culicy systems, security, rate limits, subscriptions, or AI safety controls.

· Create multiple accounts to evade restrictions, suspensions, bans, usage limits, or payments.

· Share another person’s personal information without their consent.

6. AI Features and Safety Rules

AI IMPORTANT NOTICE

Culicy is an AI-powered cooking and meal-planning app. Culicy is not a doctor, dietitian, nutritionist, allergist, food-safety authority, or emergency service. AI output is informational and may be incomplete, inaccurate, unsafe, or unsuitable for your personal circumstances.

· Always verify ingredients, quantities, cooking times, temperatures, allergens, substitutions, and food-safety steps before cooking or eating.

· Consult a qualified healthcare professional before making major dietary changes, especially if you have allergies, medical conditions, are pregnant, are a minor, or follow a medically supervised diet.

· Do not rely on Culicy or AI output for medical nutrition therapy, diagnosis, treatment, emergency advice, eating disorder support, or allergen detection.

· AI image recognition, pantry scanning, speech recognition, translations, and generated recipes may be inaccurate. You remain responsible for verifying output.

· Do not attempt to jailbreak, manipulate, bypass, or weaken Culicy’s AI safety systems or prompts.

· Do not use Culicy to generate or distribute harmful, illegal, deceptive, unsafe, abusive, infringing, or spam content.

7. Community Features and Guidelines

Culicy community spaces are designed for food, cooking, recipes, ingredients, meal plans, and the culinary experience. Your use of community features is subject to the Community Guidelines, which form part of these Terms.

· Content you post may be visible to other users together with your username, profile image, and public profile information.

· You are responsible for what you post and for ensuring you have the rights and permissions needed to share it.

· We may use automated systems and human review to moderate content, detect abuse, enforce safety rules, and protect users.

· We may remove, limit, demote, restrict, suspend, or terminate access to posts, comments, profiles, or accounts that violate these Terms, our Community Guidelines, or applicable law.

· Use the in-app reporting tools or contact support@culicy.com to report violations.

8. Your Content and Intellectual Property

8.1 Your content

You retain ownership of recipes, photos, comments, posts, feedback, and other content you submit to Culicy ("User Content").

By posting or submitting User Content, you grant Culicy a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, reproduce, display, perform, distribute, modify, adapt, create derivative works from, and use that content as necessary to operate, improve, protect, and promote the Service. This licence ends when you delete the content or your account, except where continued use is reasonably necessary for backups, legal compliance, safety, moderation, dispute resolution, or where the content has been shared with others and they have not deleted it.

8.2 Your promises about content

· You have the rights needed to submit and share your User Content.

· Your User Content does not violate the rights of others or any applicable law.

· Your User Content complies with these Terms, the Privacy Policy, and Community Guidelines.

8.3 Culicy intellectual property

Culicy, including its software, design, branding, logos, text, prompts, interfaces, algorithms, databases, and related content, is owned by Culicy AI Innovations or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, reverse engineer, or exploit any part of Culicy except as permitted by these Terms or applicable law.

8.4 AI-generated content

AI-generated recipes, meal plans, and outputs are provided for personal, non-commercial use unless we expressly permit otherwise. We do not guarantee that AI output is original, accurate, non-infringing, safe, or suitable for your intended use. You are responsible for reviewing and validating AI output before relying on it or sharing it.

9. Privacy and Data Protection

Your use of Culicy is also governed by the Privacy Policy at https://culicy.com/privacy. The Privacy Policy explains what information we collect, why we collect it, how we use it, who processes it on our behalf, how long we keep it, how we protect it, and how you can exercise privacy rights.

Culicy may use trusted service providers for authentication, cloud hosting, databases, storage, AI processing, analytics, crash reporting, notifications, text-to-speech, speech-to-text, advertising where applicable, and payments. Details are provided in the Privacy Policy.

Do not share sensitive financial information, confidential documents, government identity numbers, medical records, or highly sensitive personal information in AI chat or community areas unless the feature specifically requires it and you understand the privacy implications.

10. Service Availability, Updates, and Changes

· We may add, remove, suspend, limit, or change features, plans, AI models, usage limits, community tools, and supported countries at any time.

· We may perform maintenance, updates, security changes, or service migrations that temporarily affect availability.

· We do not guarantee that the Service will always be available, uninterrupted, secure, error-free, or compatible with all devices or operating systems.

· We may release updates that are required for continued use. Older app versions may stop working or receive limited support.

11. Suspension, Termination, and Enforcement

We may suspend, restrict, or terminate your account or access to Culicy, with or without notice, if we reasonably believe that:

· you violated these Terms, the Privacy Policy, Community Guidelines, or applicable law;

· your account is fraudulent, abusive, unsafe, compromised, unverified, or unauthorised;

· you misuse subscriptions, payments, refunds, usage limits, AI safety systems, or community features;

· you create legal, security, operational, financial, or reputational risk for Culicy, users, or partners; or

· we are required to do so by law, court order, platform rule, or government request.

Suspension or termination may result in loss of access to content, features, subscriptions, or community participation, subject to applicable law and platform rules. We may preserve information where reasonably necessary for safety, legal, security, audit, tax, accounting, dispute, or enforcement purposes.

12. Disclaimers and Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CULICY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

We do not warrant that Culicy, AI output, recipes, meal plans, pantry scans, speech features, community content, or third-party services will be accurate, complete, reliable, safe, available, uninterrupted, error-free, or suitable for your needs.

Some jurisdictions do not allow certain warranty exclusions or limitations. In those jurisdictions, the exclusions apply only to the maximum extent permitted by law, and you may have additional rights that cannot be waived.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CULICY AI INNOVATIONS, ITS PROPRIETOR, SERVICE PROVIDERS, LICENSORS, AND AFFILIATED PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, DEVICE ISSUES, OR COST OF SUBSTITUTE SERVICES.

This limitation includes claims arising from AI-generated recipes, incorrect ingredients, missed allergens, unsafe cooking practices, dietary choices, community content, user content, app unavailability, account suspension, data loss, or third-party services.

WHERE LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF: (A) THE AMOUNT YOU PAID TO CULICY THROUGH THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50 OR THE EQUIVALENT IN LOCAL CURRENCY.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or non-waivable consumer guarantees.

14. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Culicy AI Innovations, its proprietor, service providers, licensors, and affiliated parties from and against claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, your violation of these Terms, or your violation of another person’s rights. This obligation does not apply where prohibited by law.

15. Consumer Rights and Regional Terms

Nothing in these Terms is intended to limit rights you cannot waive under the consumer, privacy, digital services, subscription, or product laws that apply where you live.

Canada	Provincial and federal consumer protection laws may apply, including non-waivable rights in your province or territory.

EEA / UK / Switzerland	Mandatory consumer protection, digital services, withdrawal, and data protection rights may apply and are not waived by these Terms.
Other regions	You retain any mandatory rights granted by the laws of your country, state, province, or territory.

16. Governing Law and Dispute Resolution

16.1 Informal resolution first

Before filing a formal claim, please contact legal@culicy.com. We will try to resolve disputes in good faith within 60 days, unless a shorter period is required by law.

16.2 Governing law

Subject to your mandatory consumer rights, these Terms are governed by the laws applicable to Culicy AI Innovations at the proprietor’s place of business. If local consumer law gives you rights to bring claims in your country, state, or province, these Terms do not take those rights away.

16.3 United States users

Where permitted by law, disputes may be resolved by binding individual arbitration rather than court, except for small-claims matters and claims that cannot legally be arbitrated. You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@culicy.com with the subject "Arbitration Opt-Out".

16.4 Class action waiver

Where permitted by law, disputes must be brought only on an individual basis and not as a class, collective, representative, or consolidated action. If this waiver is unenforceable for a particular claim, that claim may proceed only as permitted by applicable law.

16.5 Other users

If binding pre-dispute arbitration or class-action waivers are not enforceable under your local consumer law, this Section does not limit your right to bring claims in local courts or use local consumer dispute-resolution mechanisms.

17. Changes to These Terms

We may update these Terms from time to time as Culicy evolves, as laws change, or as we add new features, subscriptions, regions, AI models, or community tools. The updated version will be posted at https://culicy.com/terms with a new effective date or version number.

For material changes, we will provide reasonable notice where required, such as by in-app notice, email, or other appropriate method. Continued use of Culicy after changes take effect means you accept the updated Terms. If you do not agree, stop using the Service and delete your account before the changes take effect.

18. General Terms

· Entire agreement: These Terms, the Privacy Policy, Community Guidelines, and any in-app purchase terms form the complete agreement between you and Culicy regarding the Service.

· Severability: If any part of these Terms is found invalid or unenforceable, the remaining parts remain in effect.

· No waiver: If we do not enforce a provision immediately, that does not mean we waive the right to enforce it later.

· Assignment: You may not transfer your rights or obligations under these Terms without our consent. We may transfer these Terms as part of a merger, acquisition, reorganisation, sale, or transfer of business assets, subject to applicable law.

· Force majeure: We are not responsible for delays or failures caused by events beyond our reasonable control, including outages, natural disasters, war, labour issues, cyberattacks, government actions, platform restrictions, or failures of third-party providers.

· Language: These Terms are provided in English. Translations may be provided for convenience. If there is a conflict, the English version controls to the extent permitted by law.
